1. Services Overview

CapstoneConnect.ai provides AI-powered tools, marketing strategies, and automation services designed to help businesses generate, capture, and convert leads. Results may vary based on market conditions, competition, and client participation.

2. No Guarantee of Results

While we provide data-driven strategies and tools, we do not guarantee specific revenue outcomes, lead volume, or business growth. Any projections, estimates, or examples are for illustrative purposes only.

3. User Responsibilities

You agree to:

• Provide accurate and complete information
• Respond to leads in a timely manner (unless automation services are managing responses)
• Maintain any required third-party accounts (Google, CRM, etc.)

Failure to do so may impact results.

4. Payment Terms

• Fees are outlined in your agreement, proposal, or invoice
• Payments are due within 30 days unless otherwise stated
• Late payments may incur a 1% monthly fee after 45 days
• Services may be paused for non-payment

5. Subscription & Cancellation

• Services may require a minimum 3-month commitment, unless otherwise stated
• After the initial term, services continue month-to-month
• Cancellation requires 30 days written notice

6. Third-Party Platforms

Our services may integrate with third-party tools (Google, Meta, CRM platforms, AI providers, etc.). We are not responsible for outages, policy changes, or performance issues related to these platforms.

7. Intellectual Property

All systems, strategies, and materials provided by CapstoneConnect.ai remain the intellectual property of the Company unless otherwise agreed in writing. Clients are granted a limited, non-transferable license to use deliverables during the engagement.

8. Limitation of Liability

To the fullest extent permitted by law, Capstone Marketing AI LLC shall not be liable for:

• Indirect or consequential damages
• Loss of revenue or profits
• Business interruptions

Total liability shall not exceed the amount paid by the client in the previous 30 days.

9. Disclaimer

All services and tools are provided “as is” without warranties of any kind, express or implied.

10. Governing Law

These Terms shall be governed by the laws of the State of Alabama.

11. AI & Automation Services

Our services include AI-powered call agents, automated marketing tools, and related automation systems. By engaging our services, you acknowledge and agree that:

• AI agents may interact with your customers on your behalf
• You are responsible for ensuring compliance with applicable laws regarding automated communications in your jurisdiction
• Performance of AI systems may vary based on call volume, training data, and integration quality
• We reserve the right to update, modify, or improve AI systems as part of ongoing service delivery

12. Confidentiality

Both parties agree to keep confidential any proprietary information, business data, or trade secrets shared during the engagement. This obligation survives termination of the agreement.

13. Indemnification

You agree to indemnify and hold harmless Capstone Marketing AI LLC, its officers, employees, and agents from any claims, damages, or expenses arising from your use of our services, your violation of these Terms, or your violation of any third-party rights.

14. Dispute Resolution

In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in the State of Alabama, in accordance with the rules of the American Arbitration Association.

You waive any right to participate in a class action lawsuit or class-wide arbitration.

15. Entire Agreement

These Terms, together with any signed agreement or proposal, constitute the entire agreement between you and Capstone Marketing AI LLC regarding the subject matter herein and supersede all prior agreements or understandings.
